Неустойкою (штрафом, пенею) є грошова сума, яку боржник повинен передати кредиторові у разі порушення зобов'язання. Пенею є неустойка, що обчислюється у відсотках від суми несвоєчасно виконаного грошового зобов'язання за кожен день прострочення виконання.
