1. Регулювання діяльності із спільного інвестування здійснюють держава та саморегулівна організація професійних учасників ринків капіталу - об’єднання учасників ринків капіталу, що провадять професійну діяльність на ринках капіталу - діяльність з управління активами інституційних інвесторів.

2. Державне регулювання у сфері спільного інвестування здійснює Комісія.
